These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and RiskFreeProp™ ("RiskFreeProp", "we", "us", "our"), governing your access to and use of the website at riskfreeprop.com and all related tools, dashboards, calculators, and services (together, the "Service"). By creating an account, ticking the acceptance box at sign-up, accessing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
You must be at least 18 years old and legally able to enter into a contract to use the Service. By using the Service you represent that you meet these requirements and that all information you provide is accurate and current. You are responsible for complying with all laws that apply to you in your country of residence, and you must not use the Service where it is prohibited by local law.
RiskFreeProp provides risk-analytics and compliance-monitoring software for informational and diagnostic purposes only. It helps traders model, visualise, and track rule parameters (such as drawdown floors, daily loss limits, contract sizing, consistency targets, and survivability estimates) for third-party proprietary trading firm ("prop firm") programs.
RiskFreeProp is a software provider, not a broker, dealer, exchange, financial adviser, or financial institution. We do not execute trades, manage funds, hold customer money, or guarantee passing rates, payouts, or outcomes for any evaluation program (including but not limited to Crypto Fund Trader, Apex Trader Funding, Topstep, or any other firm). Users assume one hundred percent (100%) of all trading risks and all consequences of their trading decisions.
The Service is not, and must not be relied upon as:
RiskFreeProp is an independent software tool and is not affiliated with, endorsed by, sponsored by, or partnered with Crypto Fund Trader, Apex Trader Funding, Topstep, Breakout, FTMO, FundingPips, FundedNext, or any other prop firm, platform, or exchange, unless we expressly state a partnership in writing. All third-party names, logos, and trademarks are the property of their respective owners and are used only for identification and descriptive purposes (nominative fair use). You are entirely responsible for verifying that your settings and trading comply with your specific prop firm's live, current rule set.
While the Service helps you track rules, the official prop firm's live dashboard, agreement, and risk system are always the ultimate and controlling source of truth. If there is ever any discrepancy, delay, or conflict between what RiskFreeProp displays and what your prop firm's official platform shows, you must rely on the prop firm's official data, and you are solely responsible for doing so. RiskFreeProp bears no liability for any discrepancy.
RiskFreeProp does not have direct API connections, backends, or live integrations into prop firms' proprietary servers or accounts. The Service calculates estimates based on the standard inputs and parameters you enter and select. Accordingly, we do not and cannot guarantee real-time synchronization, accuracy, or parity with any external firm platform, balance, or rule engine. Outputs may differ from your live account for many reasons, including input error, timing, fees, slippage, or rule changes.
Prop firms frequently alter their challenge criteria, drawdown calculations, contract-scaling tiers, consistency rules, payout terms, and news-trading and other restrictions at any time and without warning. RiskFreeProp's rule data is our interpretation of publicly available information and may be outdated, incomplete, or incorrect at any given moment. If a prop firm changes a rule and the Service has not yet been updated, that is an inherent limitation you accept. You must manually ensure your parameters match your current, active contract and the firm's current published rules before relying on any output.
You agree not to: (a) use the Service for any unlawful, fraudulent, or abusive purpose; (b) attempt to gain unauthorised access to the Service, other accounts, or our systems; (c) reverse engineer, scrape, copy, or resell the Service except as permitted by law; (d) interfere with or disrupt the Service; (e) upload malicious code; or (f) misrepresent your identity or affiliation. We may suspend or terminate your access for any breach.
Certain features require a paid plan (monthly, yearly, or lifetime). Prices are shown at checkout and may change. Payments may be processed by third-party providers (including cryptocurrency payment processors); their terms also apply. Unless expressly stated or required by applicable law, all fees are non-refundable. You are responsible for any taxes applicable to your purchase. We may modify, add, or discontinue plans and features at any time.
The Service may display affiliate or partner links to third parties. We may receive compensation if you sign up or purchase through those links. Any discount, bonus, or verification benefit is subject to the applicable third party's terms and to change or withdrawal at any time. We are not responsible for third-party products, services, or conduct.
The Service, including its software, design, text, and the RiskFreeProp name and logo, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial risk-tracking. All rights not expressly granted are reserved.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY OUTPUT, RULE, CALCULATION, OR FIGURE WILL BE ACCURATE, CURRENT, COMPLETE, OR RELIABLE. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.
Trading financial instruments — including futures, forex, CFDs, crypto, and prop-firm simulated or funded accounts — carries substantial risk. You acknowledge and agree that you may lose evaluation fees, subscription fees, funded status, payouts, and capital, and that RiskFreeProp is a diagnostic tool that cannot prevent such losses. You assume 100% of all trading risk and accept full responsibility for every decision made while using the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISKFREEPROP AND ITS OWNERS, OPERATORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOST PAYOUTS, FAILED OR BREACHED EVALUATIONS OR FUNDED ACCOUNTS, LOST FUNDED STATUS, LOST DATA, OR LOST OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY RELIANCE ON ITS OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL RISKFREEPROP'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED THE TOTAL AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR, IF YOU PAID US NOTHING, USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless RiskFreeProp and its owners and operators from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal and arbitration fees) arising out of or related to your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
We reserve the right, at our sole discretion, to modify, update, suspend, or discontinue any part of the Service, and to change these Terms and our Privacy Policy, at any time and without prior notice. When we change these Terms, we will update the "Last updated" date above. Changes take effect when posted. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (including Disclaimers, Assumption of Risk, Limitation of Liability, Indemnification, and Dispute Resolution & Governing Law) will survive termination.
RiskFreeProp is a global, digital service. To keep disputes fast, private, and location-independent, the parties agree that all disputes are resolved by binding online arbitration, and not in court, to the fullest extent permitted by applicable law.
(a) Governing Law. These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict-of-law principles or the U.N. Convention on Contracts for the International Sale of Goods.
(b) Informal Resolution First. Before commencing arbitration, you agree to first contact us at riskfreeprop-support@googlegroups.com and attempt to resolve the dispute informally. We will endeavour to resolve it by correspondence within thirty (30) days of receiving your written notice.
(c) Binding Online Arbitration (exclusive remedy). If the dispute is not resolved within thirty (30) days, it shall be finally and exclusively settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or, at our option, the International Chamber of Commerce (ICC) Rules). The arbitration shall be conducted by a single arbitrator, entirely online and remotely — by video conference, telephone, and/or written submissions — with no requirement for either party to physically appear at any court or geographic location. The seat of arbitration is Delaware, USA; the language is English. The arbitrator's award is final and binding.
(d) No Court Proceedings; Waiver of Jury Trial. Except as set out in sub-section (f), you and RiskFreeProp waive any right to litigate disputes in any court and waive any right to a trial by judge or jury. Any court proceeding brought in breach of this clause may be stayed or dismissed in favour of arbitration.
(e) Class-Action Waiver. All disputes shall be brought solely on an individual basis. Class actions, class arbitrations, collective actions, and representative actions are strictly prohibited. The arbitrator may not consolidate more than one person's claims.
(f) Narrow Court Carve-Outs (in our favour). The only matters that may be brought before a court of competent jurisdiction are: (i) an application to recognise or enforce an arbitration award; and (ii) an application for urgent injunctive or equitable relief to protect intellectual-property rights or confidential information, or to prevent unauthorised use of the Service, pending arbitration.
(g) Costs. Unless the arbitrator or applicable mandatory law determines otherwise, each party bears its own costs and an equal share of the arbitrator's and administrative fees.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
